Rental Terms & Conditions

These Terms & Conditions form the rental agreement between Hoppin Habitats (the Owner — Tarik Telesnitsky, 140 Boundary St, Tingalpa QLD 4173) and the person hiring the vehicle (the Renter). By signing, paying a deposit, or taking possession of the vehicle, the Renter agrees to be bound by these Terms.

If anything here doesn't make sense, ask before you sign. Once you've signed, this is the agreement.

1. Who can drive

1.1 Only drivers we've approved in writing may drive the vehicle. Every driver must be listed in the rental agreement before pickup.

1.2 Every approved driver must:

1.3 If the vehicle is driven by anyone not approved by us, or by anyone whose licence is suspended, cancelled, expired, restricted, or invalid for the class of vehicle:

1.4 We may refuse to release the vehicle if a listed driver cannot produce their licence at pickup, or if we have reasonable concerns about a driver's fitness to drive.

2. Zero tolerance — drugs and alcohol

2.1 The vehicle must not be driven by anyone:

This is non-negotiable and is the single fastest way to lose your bond and a great deal more.

3. Where you can and can't drive

3.1 Permitted: All sealed public roads in Australia.

3.2 Not permitted (without our prior written approval):

Using the vehicle in any way under 3.2 (without approval) or 3.3 voids the insurance and makes the Renter fully liable for any damage or loss.

4. Bookings, payment, and cancellations

4.1 Booking confirmation. A booking is confirmed once we've issued written confirmation and you've paid the $250 reservation deposit (see 4.2).

4.2 Reservation deposit. A $250 reservation deposit is required to hold the booking, payable within 24 hours of submitting the booking form. The deposit is held against the total hire cost. If the deposit isn't received within 24 hours, the dates are released.

4.3 Balance and bond. The balance of the hire cost, plus the bond, is paid at pickup, in person on the day we hand over the vehicle. We'll confirm the exact amounts in the booking-confirmation email. The bond is held separately and refunded after return inspection (see clause 9).

4.4 Accepted payment. Bank transfer or Wise (PayID, card, or transfer). Card payments may attract a surcharge equal to the processing fee.

4.5 Card on file. By accepting these Terms, you authorise us to charge the payment method on file for any unpaid amount that falls due under this agreement (excess kilometres, cleaning, fuel shortfall, damage beyond the bond, tolls, fines, administrative fees). We'll notify you before charging.

4.6 Cancellation by the Renter. The $250 reservation deposit is fully refundable if you cancel more than 10 days before pickup. Within 10 days of pickup, or for a no-show, the $250 is forfeited. The bond is always refunded in full if the booking is cancelled before pickup. Because the balance is paid at pickup, no further refund question arises for cancelled bookings.

4.7 Cancellation by us. We may need to cancel a booking if the vehicle becomes unavailable through mechanical failure, accident, insurance issue, or other circumstances beyond our control. If this happens we will:

We are not liable for any other loss caused by an owner-side cancellation (accommodation, flights, missed plans, indirect or consequential loss).

4.8 Changes. Date changes more than 14 days out: free of charge subject to availability. Within 14 days: $50 admin fee plus any difference in the new rate.

4.9 Early return. No refund is payable for hires that end earlier than the booked return date.

5. Pickup, return, and inspections

5.1 Pickup. By appointment at our Tingalpa workshop, 140 Boundary St, Brisbane QLD 4173, unless we've agreed otherwise.

5.2 Pre-departure inspection. Before you drive away we'll walk you through the vehicle and complete a written/photographic condition report. By signing it, you confirm the vehicle's condition at handover. Any damage not recorded on this report will be treated as new damage on return.

5.3 Late return. If the vehicle is returned later than booked without our written agreement:

5.4 After-hours return. Only with prior written approval. The vehicle must be parked and secured as instructed. Until our next-business-day inspection, the vehicle remains the Renter's responsibility.

5.5 One-way hires. Where we've agreed to a one-way drop-off (e.g. Brisbane → Sydney/Melbourne), the agreed drop-off location, time, and one-way fee will be set out in the booking confirmation. The Renter remains responsible for the vehicle until the drop-off is accepted in writing.

6. Distance, fuel, and tolls

6.1 Distance. 200 km per day, averaged across the hire period. Unused kilometres accumulate. Excess is charged at $0.30 per kilometre.

6.2 Fuel. The vehicle is supplied full and must be returned full. If returned short, you'll be charged the cost of the missing fuel plus a $30 administration fee.

6.3 Tolls, fines, infringements. The Renter is responsible for all tolls, fines, and infringements (parking, speeding, etc.) incurred during the hire. We pass these on as they're received, plus a $25 administration fee per item to cover transfer/admin time.

7. Insurance, excess, and liability

7.1 The Owner's insurance. Each vehicle carries motor insurance held in the Owner's name. The applicable insurer, policy type, and excess for your hired vehicle are disclosed in the booking confirmation. Insurance is held for the Owner's benefit. The Renter is not a named insured.

7.2 The bond is the excess. The bond you pay is the standard insurance excess for the vehicle. If a claim is made under the policy:

7.3 Renter remains fully liable (no insurance cover, no excess cap) for loss or damage arising from:

7.4 Loss-of-use. Where damage takes the vehicle off the road, the Renter is also liable for the daily hire rate for each day the vehicle is unavailable, up to the lesser of (a) actual repair time or (b) 21 days.

7.5 No double-cover assumption. If you hold separate excess-reduction or travel insurance, that's a matter between you and your insurer. We will provide reasonable documentation to support your claim. You remain primarily liable to us under this agreement.

8. Looking after the vehicle

8.1 General. Drive carefully and within the law. Don't ignore warning lights. Don't keep driving after an impact, overheating, fluid loss, or other warning event — pull over and call us.

8.2 The campervan fit-out. The fit-out (cabinetry, electrical, plumbing, fridge, water systems, bedding) is not covered by motor insurance for misuse damage. Specifically:

8.3 No smoking, vaping, or illicit substances. No smoking, vaping, or use of illicit substances inside the vehicle or by anyone in the vehicle. Breach incurs a flat $400 cleaning and remediation fee plus any actual costs above that.

8.4 No pets unless agreed in writing before the booking. Where agreed, an additional $80 pet cleaning fee applies on return.

8.5 No modifications. Don't add accessories, mounts, stickers, or alterations to the vehicle.

9. The bond

9.1 The bond ($1,500 or $4,000 depending on the tier selected) is paid before pickup and held separately from the hire payment.

9.2 The bond may be applied against any of:

9.3 Any remaining bond balance is refunded within 15 days of return, subject to inspection and final processing of any tolls/fines that may still be in transit. If an unresolved insurance claim is open, the bond may be held until the claim is closed.

10. Cleaning and condition

10.1 Return condition. Return the vehicle in reasonably clean condition — exterior rinsed, interior swept and wiped, rubbish removed, dishes washed, sheets bagged. We handle laundry and detailing.

10.2 Excessive cleaning. Where the vehicle needs more than standard cleaning (mud, sand, red dirt, animal waste, food spills, strong odours, insect or biosecurity contamination):

10.3 Wear vs damage. Normal wear (minor marks, light scuffs from careful use) is on us. Cracks, chips, dents, stains, burns, broken fittings, lost equipment, water ingress damage, and tears are on the Renter.

11. Accidents, damage, and breakdowns

11.1 Report immediately. Any accident, damage, theft, or significant incident must be reported to us as soon as it's safe to do so, and in any case within 24 hours.

11.2 Police reports. Obtain a police report where required by law (injury, theft, hit-and-run, significant property damage, intoxication suspected).

11.3 Don't admit liability. Don't accept blame or sign anything admitting fault at the scene without speaking to us first.

11.4 Roadside assist. RACQ roadside assistance is included. Call the number on the dashboard card. Standard RACQ cover applies — non-fault breakdowns are covered; user-caused issues (lockout, flat from leaving lights on, wrong fuel) may incur RACQ call-out fees that are passed through to the Renter.

11.5 Repairs. Don't authorise repairs without our written approval, except minor work to prevent further damage where you can't reach us. Unauthorised repairs are not reimbursed.

12. Vehicle abandonment

The vehicle must never be left unattended for extended periods without notifying us, and must never be abandoned. Recovery, towing, storage, and any associated losses are the Renter's responsibility.

13. Personal property and contents

13.1 The Owner is not responsible for loss, theft, or damage to any personal property, luggage, valuables, equipment, or contents — whether inside the vehicle, locked away, or left at our premises.

13.2 No bailment relationship is created over personal property.

13.3 The Renter is responsible for arranging their own travel and contents insurance.

14. Weather, road closures, and force majeure

14.1 No refunds for weather events, floods, cyclones, road closures, bushfires, public health orders, or other circumstances beyond our reasonable control.

14.2 Where conditions are unsafe, we may instruct the Renter to alter their route or return early. The Renter must follow such instructions.

15. Child restraints

Child restraints are not supplied. Where required by law, the Renter is responsible for providing and correctly fitting compliant restraints. Anchor points are available — ask at handover.

16. GPS, telematics, and dashcam

16.1 The vehicle is fitted with GPS / telematics and may be fitted with a dashcam (audio and/or video). These devices may be used for:

16.2 The Renter must not tamper with, disable, obscure, cover, disconnect, or otherwise interfere with these devices. Tampering may incur a $300 fee plus any repair or recovery costs.

16.3 Recording data is retained for up to 12 months and is handled in accordance with the Privacy Act 1988 (Cth) and Australian privacy laws. Data may be disclosed to insurers, regulators, or law enforcement where required or permitted by law.

16.4 By signing this agreement, the Renter and any passengers consent to being recorded inside and around the vehicle. The Renter is responsible for informing passengers.

17. Privacy

The Owner collects licence details, identity information, addresses, contact information, payment data, vehicle-use data, and related information for rental administration, compliance, enforcement, insurance, and business purposes.

Information may be disclosed to insurers, toll operators, regulators, service providers, or law enforcement where required or permitted by law. We do not sell personal information.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

18. Indemnity

The Renter indemnifies the Owner against all loss, damage, claims, demands, costs, and expenses (including legal costs on a solicitor-client basis) arising out of or in connection with:

This clause does not require the Renter to indemnify the Owner for loss or damage caused by the Owner's own negligence or breach of agreement.

19. Termination

The Owner may terminate this agreement and recover the vehicle without refund where:

Termination does not limit the Owner's right to recover any loss or damage.

20. Limitation of liability

20.1 Nothing in this agreement excludes, restricts, or modifies the Renter's rights under the Australian Consumer Law (ACL) and the consumer guarantees that apply to the supply of services.

20.2 Subject to clause 20.1, the Owner is not liable to the Renter for:

21. Notices, severability, and entire agreement

21.1 Notices. Notices under this agreement may be given by email to the address provided at booking, or in writing to 140 Boundary St, Tingalpa QLD 4173.

21.2 Severability. If any clause is found unenforceable, it is severed and the remainder continues in force.

21.3 Entire agreement. This agreement, together with the booking confirmation and the signed condition report, is the entire agreement between the parties relating to the hire. Earlier communications and quotes are superseded.

21.4 Variations. Variations must be in writing and signed (electronic signatures accepted).

22. Governing law

This agreement is governed by the laws of Queensland, Australia. The parties submit to the exclusive jurisdiction of the courts of Queensland and any courts that hear appeals from them.

Renter acknowledgement

By signing the booking step (or by ticking the acceptance box at the booking step), the Renter confirms they have read, understood, and agree to these Terms & Conditions, and that they have authority to bind any additional drivers listed on this booking to the same Terms.
